BC Court of Appeal dismisses Berner bid

BC's highest court has quickly dismissed a bid by Carol Berner to avoid jail time.


Within minutes of closing today's hearing in the BC Court of Appeal the three judges came back and said it was dismissed and they would deliver their reasons at a later date.


Berner could still file another appeal with the Supreme Court of Canada, but she must start serving her two and a half year sentence today.


She has only served two weeks before being granted bail in 2010.


She killed four year old Alexa Middelaer in May of 2008 when her speeding car crashed into the child and her aunt as they were feeding a horse.


Alexa's father was in court for today's decision.


Michael Middelaer says he is not expecting berner to end the battle, which has now dragged on longer than his daughter was alive.

    "Sometimes people deserve a good slap".

    I wonder how many times thoughts like that go through a judge's mind. I wonder how often they wish they could pull a Matthew Begbie, when facing irresponsible clowns like this woman.

    It's time to face the music and do the time, B#$%^. You should serve the entire sentence too, since you obviously have no acceptance you did anything wrong. Something tells me another appeal is coming. Instead how about doing something good and productive with that money. Quit wasting our court time, and further hurting a greiving family.

    Prayers and thoughts to Alexa Middelaer, and her surviving family. I can't begin to imagine the pain you've had to endure through all these years of unnecessary court pandering by Berner.

      @RichardF_4221 For all the problems this drunk has caused, her sentence should be doubled to 5 years in prison and 10 years of no driving after she gets out. Also her sentence of 5 years should start the day she goes to jail and no time off! A poor little 4 year old has lost her life due to this drunk - why won't she woman up and take her punishment. I hope she has a ruff time in jail!!!

    everyone seems to have a sane head except carol berner. stop this redundant appeal bs once and for ever on this woman she has had enough chances , all rejected. the people of bc want to see justice served on this woman , put her in jail NOW.

    She should have been given a longer sentence today by the judge for being so selfish about not accepting responsibility. This women should be ashamed of herself, she killed a little girl and destroyed a family by doing this and now she is dragging the entire family and the justice system through the mud. Lock her up for a longer time and let her think about it a little longer and maybe she will feel some sympathy for the family. She sounds like a real cow!!!

    Great news and I hope Berner suffers each day in jail to the utmost.Who does this bag think she is?????Serve your time fully and I hope she gets more time.

    finaly, some justice for that young girl and her family, although we can be rest assured she will exhaust all levels of appeal....truly, a real coward. hopefully shes in a 6 x 6 as we speak

    I am no psychologist, but she has to acknowledge her actions and accept her fate. The poor beautiful Alexa will never see another sunny day. Berner should be thrown in jail for at least 10 years with no possibility of appeal. She is just a waste of space.
