UPDATES: Auditor General loses bid for more BC Rail documents

BC's Chief BC Supreme Court judge has blocked the latest attempt to explain why the legal fees of two convicted criminals, linked to the BC Rail scandal, were paid by the province.

Auditor General John Doyle has been seeking access to documents currently covered by lawyer-client privilege.

They involve taxpayers spending six million dollars to end the prosecutions of Dave Basi and Bob Virk, two former Liberal party staffers who pleaded guilty to corruption charges in 2010.

Chief Justice Robert Bauman's  42-page judgment has determined solicitor-client privilege must be protected because it is 'fundamental to the proper functioning of our legal system'.

He says he understands Doyle's quest for transparency and accountability, but he doesn't agree with claims 'audits in both public and private sectors require access to confidential and privileged documents.'

Doyle's lawyer had argued privilege could still be protected by only letting the auditor general examine sensitive documents.
No word yet on whether Doyle plans to appeal today's ruling.

A former Liberal MLA --who once served as Solicitor General- - admits he's disappointed by today's ruling.  John Van Dongen was granted intervenor status in the case.

"A little bit disappointed, but I think it does clarify the kind of amendments to the legislation that may be required if the Legislature feels that it's important in cases like this to infringe on, if you will, solicitor-client privilege. The judge makes it clear that's a sacred trust in terms of a conversation and discussions between a lawyer and their clients."

Van Dongen -- who's now sitting as an independent MLA for Abbotsford-South -- says his decision to quit the Liberals was partly based on this investigation.

    Chief justice cites no evidence that government is withholding anything from auditor general. Okay, so why the continued cover-up? So much for transparency. What a travesty.
    This could have settled the controversy around these dodgy payout and the Liberals corruption. Instead, it just makes it all the more suspect.
    All at taxpayers expense!

    Gordon Campbell was going ahead with a full inquiry on the Glen Clark government on the fast cat ferries, and had to cancel due to the high cost of the inquiry to the taxpayers of B.C. We will never know how much Jack Munro was paid.

    The same will happen with Adrian Dix on his inquiry. His answer will be that he cannot justify the cost of it to the taxpayers.

    No surprise with his decision, however because it might just begin to expose the abuse when it comes to OUR tax dollars, particularly in the dysfunctional (in-) justice system.
    Sad we don't have any accountability when it comes to our tax dollar spending. And politicians wonder why the public has lost all respect for them. TIP: look in a mirror.

      @bctaxpayer No, but I hoped for a different outcome too, but if the judge found solicitor client privilege existed, - which appears to be the case - he made the right decision.

    I support the NDP. May can not come quick enough. I think Christy and company are criminals... look at the 15 million they are spending on ads promoting the liberals although it is supposedly just informing the public. Makes me sick. However, I don't want to see an inquirey, why throw good money after bad. Unless we were going to get sustantial jail terms it would be just padding lawyers pockets. An endless epic of appeals and injunctions. I would just like to see Christy and co. ride off never to be heard from again.

    Taxpayers voted in a NDP government in 2009 in Nova Scotia and are now going to put them back into opposition status.

I also think that socialists,contrary to what you may think, have economic sense, and can run an economy where more money will get to the average person.The mantra of the liberals and capitalists is that we must bow down to the rich so we can get a pittance. However, that doesn't happen, and if it takes a government to ensure that it does, well so be it. If they want to relocate overseas, then the company owners can go live in Beijing.     I believe the NDP will win in May (based mostly on massive corruption and lies within the BC Fiberal Party) and then because the NDP won't make many (major) changes, they'll win a second term in 2017. After that (but not before) you may see the same kind of arrogance that the BC Lieberal Party has been displaying, for the last several years.

    I hope not. I hope the NDP has learned from the mistakes of Gordon Campbell and his band of corporate buddies. You cannot ignore the people and lie right to their faces on a daily basis, while you undermine their wellbeing, and get away with it for long. I hope the BC Liberal Party is destroyed in May. They don't even deserve to exist in BC anymore. They've damaged our province too much.

    Why is IT that than when the Saskatchewan taxpayers had a provincial election in 2011, before the election call the NDP was the official opposition party with 20 seats, and after the election was over, they had only 9 seats and the NDP leader even lost his seat?

    Why is that Saskatchewan does not have one elected federal MP elected when it fact at one time it was known as Tommy Douglas country?

    Why is it that with Manitoba taxpayers re-electing a NDP government in 2011, the opinion of the taxpayers today is to vote for the opposition Progressive Conservative?
