Sentence appeal next for Carol Berner

With her conviction appeal dismissed Tuesday, next up for Carol Berner is appealing her sentence.
    
Berner's lawyer, Jason Tarnow, says the court will assess if the 30 month sentence Berner was given for  killing four year-old Alexa Middelaer is appropriate.

Tarnow says he believes it is excessive.  "You might be shocked to hear but there's people who have done much worse than Carol Berner did who received a much lesser sentence - across the country."

Tarnow says the sentencing appeal was filed long ago - at the same time as the conviction appeal.

Berner is convicted of impaired driving in the crash that killed Alexa. She was sentenced in 2010.

    Get your butt in jail where it belongs. Haven't you put this family through enough. I hope they increase the sentence.

      @RoseH_1028 I so agree with you Rose, this is bullshit!! I think a minimum of 10 years and I mean extreme minimum would suffice with this criminal act. She knows dam well she killed the girl because she was so juiced. Does she feel no guilt at all? If not, be worried when she gets out of jail, people with no remorse for things they do wrong go on to bigger more hateful crimes.

    Carol Berner must face the fact that a price is attached now to her conviction.

    Her sentence thus far seems very fair, but she has nothing to fear except fear itself. If I was in her shoes I would not appeal the sentence period. ms. The lawyers that represent her while looking for any available out are digging he a large hole.

    The only ones getting rich, in spite of good will is of course her lawyers.

    Bu the way the Delta Police did an excellent job of their investigation into this tragic event.

    Others across this country have received less time and for worse crimes? So what! It is about time our courts begin sentencing people like this with an appropriate amount of jail time for the crime. Come on!
    Ms Berner continues (through her Lawyer) to dig herself a large hole, one that is receiving a heck of alot of attention. That will do her absolutely no good by the time she gets out (if she ever gets in!).

    This woman has no shame! She killed a beautiful innocent child. She needs to accept her punishment and move on.

    These kind of cases always create a high public emotional response. Sentences for this and other criminal offences are prescribed by the criminal code and directs judges on how to exercise their sentencing function. Judges refer to past decisions to ensure sentences are within a range as set out by the court of appeal.

    Obviously, the lawyers in this case have concluded the sentence is outside the sentencing range. Rather than criticize people should allow the Court of Appeal to determine the reasonableness of this sentence.
