Former TV reporter wants to appeal sentence for sex assault

A former TV news reporter convicted of child sex assault is appealing his sentence.

A provincial court judge in Surrey went above the three years Crown was asking for back in August and gave Ron Bencze four years behind bars for sexually assaulting a child over several years.

Now, Bencze's lawyer has filed for leave to appeal on the grounds that the sentence is “demonstrably unfit or clearly falls outside the acceptable range.” 

Court documents argue the judge erred “by overstating the principle of deterrence” and “failing to give appropriate weight to rehabilitation.”

They argue Bencze was remorseful, and a psychologist had testified at his sentencing hearing that he was not in fact a pedophile and was unlikely to reoffend.

The judge disagreed in handing down the sentence.

    If he was remorseful he would accept his fate! And why not go ask the child and his parents if he got a fair sentence. The real victim is trying to get on with his life and God knows what help he needs. An appeal can also go the other way too, the sentence can easily end up larger......let`s hope hey!!

    I would hope that Mr Bencze has gotten a taste of prison by now - and suspect that this maybe the motivation to file the appeal

    I think the PODS should have gotten a harsher sentence -

    Lets hope the Appeals judge has the cajones to keep the same sentence or make it longer

    Well let's face it. If any one of us were to be convicted and sentenced, and let's hope we all are good people, wouldn't you try to reduce the sentence?

    I just hope Mr. Bencze faces the highest most suitable conviction for his crime.
