A trio of East Vancouver dispensaries is planning a a constitutional challenge against the city of Vancouver’s attempt to shut it down.
The city filed an injunction to shut down three dispensaries in East Vancouver, SWED Cannabis Society, The Green Cross Society and the VanCity Medicinal Society for operating without a license.
Now, Lawyer Robert Laurie says he’s filed papers on behalf of the pot shop.
Laurie says first they are challenging a technical error in the city’s injunction. But he expects the city to return with the error fixed at which point they’ll proceed with the deeper challenge.
“As part of our response, we indicated that we intend to bring a constitutional challenge.”
Laurie says they’ll be filing under three sections of the constitution, but declined to say on what grounds they would be appealing.
“Section 2 is freedom of expression. Section 7 is security of the person, and section 15 is equality under the law.”
Last month the city filed 17 injunctions to shut down dispensaries with the promise of another 10 coming down by the end of June.
