The lawyer for a B.C. mom whose kids were returned to their abusive father by the province is asking for the courts to limit an upcoming provincial review of the case.
“We think it’s inappropriate for the Ministry of Children and Family Development to essentially have a collateral attack on the judicial system.”
Jack Hittrich says with the government appealing the scathing ruling against them, they want to ensure the man the province hired to review the tragedy is limited in his opinions.
Specifically that he not comment on whether the ministry did anything wrong.
“To basically ensure that he does not express an opinion on whether the ministry did anything wrong; because that of course is the purview of the charter acts and this matter is before the courts.”
In July the courts found B.C.’s director of child protection abused her authority and ministry staff failed the mom, identified as JP, who was trying to protect her four children from the father who had molested them.
Former civil servant Bob Plecas will hand over his review October 13th.
