An American tourist, who broke her back last summer after she was literally knocked off the Vancouver seawall by a cyclist, is now suing the City of Vancouver and the unknown biker involved.
Virginia native Charmaine Mitchell says in a notice of civil claim that she was walking on the pedestrian path near Second Beach, when she was struck, falling onto the rocky beach below.
She spoke with Global BC from her hospital bed shortly after the accident, saying it was a terrifying experience.
“I was laying there thinking that very fact, laying there on the shells; I thought that I was paralyzed… I couldn’t feel a part of my foot, but I’m grateful that I’m not.”
Mitchell alleges the city is negligent because it’s responsible for making sure the seawall is safe for users.
None of the allegations have been proven in court.
