Court ruling pleases Mom of daughter killed by drunk driver

The mother of a young woman killed by a drunk driver two years ago is pleased BC's highest court has upheld the sentence handed to an impaired driver... who took the life of someone else's child.

"She just needs to serve her time. Stop all the trying to get out of jail free card type thing and just go serve your time."

Markita Kaulius -- who lost her daughter Kassandra in May of 2011-- says she hopes the family of Alexa Middelaer will find some much-needed peace now that Carol Berner is back behind bars.

"Let the family --the Middelaer family try to begin to heal. I mean, this has dragged on for a ridiculous amount of time. It's sad that the system allows for it to carry on for this amount of time."

Kaulius heads up a group pushing for stronger sentences against drunk drivers and more consideration of victim rights.

Kaulius is also suing the driver who caused the crash that killed her 22-year old daughter.
 
In december, Natasha Warren -- who pleaded guilty last summer -- was sentenced to 37 months.

    what Marcella said during her interview with John McComb this afternoon, which almost made me drive off the road is - if Carol Berner doesn't launch another appeal ( which she is entitled to do ) then the reality is she only will be in jail for 3 months before she will likely get day parole !!!!!

    Can you wrap your mind around that ????

      @ChrisM_18 What we need is American sentencing in Canada. These two unfortunate people had their lives taken from them and their families by drunk drivers. All these 2 drunks got was 30 & 37 MONTHS and will be out on day parole within 6 months.These sentences are a crime in itself !
      We have a Canadian citizen who sold marijuana seeds to Americans and got 5 years in a US jail.

    I have a better idea. Let's hang 'em and then have a fair trial.
    Might be a good idea to save a few 'spots' for the judges, lawyers and lawmakers that allow these injustices to happen.
    To the "loons": this is not a serious idea but meant to reflect disdain for the system. So don't get your panties in a knot.

    We don't have courts of justice any more; it's courts of law and system to make lawyers wealthy.

      @BCSkulker It is interesting that BC has passed some legislation to target impaired drivers which immediately prohibits them from driving when their caught. That's providing they haven't injured or killed anyone in the process.

      I believe that this is the case from where this legislation was conceived and it is actually working a a deterrence.

      The defense lawyers are dead set against this legislation. I wonder if it has something to do with them not having as many impaired drivers to defend in criminal court.

    Given the fact, Carol Bernier killed a young child, while
    drinking and driving, yet has her focus on appeals,
    clearly, shows she has a serious problem.

    ON top of this, we do not have adeqaute laws to address
    the seriousness of drinking and driving.

    She needs intensive therapy, while incarcerated, in order to
    help her realize the magnitute of her actions and need to
    be accountable for them.

    Her lawyer is only aiding and abetting her failure to take responsibilty
    for her actions and I would say feeding off this appeal focus.

    Carol Bernier, how can you know that your drinking and driving
    killed a child, yet continue not to take responsibilty for your enormous
    bad judgement that day?
