Court to hear Berner's sentence appeal Thursday

A day after Canada's highest court rejected her latest bid to have her conviction overturned, Carol Berner will appeal her sentence at B.C.'s highest court.
 
The Delta woman who killed four-year-old Alexa Middelaer in May of 2008 was ordered to spend 2.5 years in prison, and banned from driving for five years. 
 
She's been out on bail since filing her first appeal.
 
The Supreme Court of Canada has already turned down her bid for a new trial, but the BC Court of Appeal must determine if her sentence warrants review.

Berner's car struck Middelaer and her aunt while they were feeding a horse on the side of a rural road.
 
She later confessed to undercover police, she'd been drinking, but continues to deny she caused the fatal crash.

    Suck it up Princess.............The little girl is dead. The way the system works you will be out by Labour day weekend,they cant stop you from driving and in five years it will be a distant memory!!

    For all the problems this drunk has caused, her sentence should be doubled to 5 years in prison and 10 years of no driving after she gets out. Also her sentence of 5 years should start the day she goes to jail and no time off! A poor little 4 year old has lost her life due to this drunk - why won't she woman up and take her punishment. I hope she has a ruff time in jail!!!

    Upholding a sentence of 2.5 years for killing the little girl while drunk is not going to be a resounding defence of the principles of justice . Now if the court came out and increased her time behind bars it would catch my attention!

    Carol is an embarrassment to her society and mine. Just because she's a woman she thinks everyone should feel sorry for her! I hope the appeal court sees their way and increases her time to 10 years or more, not bend to her little snivels. May you have the worst time of your life!

    Shame, shame, shame on you Carol Bernier and shame on the lawyer that is representing you. Carol, you still have not accepted responsibility for your actions. You chose to drink and drive and your bad choice resulted in killing an innocent child and injuring another. Do your time in jail and get help.

    If anything, the Appeals court should increase this woman's sentence because 2 1/2 years isn't enough to start with! It should be 10 years.

    all these wasted court days for the convicted. your welcome carol for all of us picking uo your court tab, prison tab, probation tab and on. If a person loses their appeal they should have to pay court costs.

    someone put this sad excuse for a human being in jail where she belongs once and for all....you killed a child whilr drunk what more does it take? Appeal all you want from a jail cell, why the hell is she out on bail?

    Its the family that has to suffer again by attending court evertime this drunk makes an appeal and they relive the loss of thier daughter....What a system its an absolute sham
