Supreme Court of Canada will not hear Berner appeal

Carol Berner has lost her bid to ask the country's highest court to overturn her conviction in the death of a four-year-old girl.

The Supreme Court of Canada has dismissed Berner's request to have her case heard in Ottawa.

She had filed for leave to appeal last month, after a lower court upheld her conviction last fall.

Her lawyers argue police had mishandled her file, and that new evidence has surfaced in a related civil matter.

Berner was found guilty of impaired driving causing Alexa Middelaer's death on a Delta road in 2008. 

She was sentenced to two and a half years in prison.

She's appealing that too – at the B.C. Court of Appeal in Vancouver tomorrow.

    Good! Go to jail! You are guilty and you should be going to jail for at least 10 years after what you did. Fact is, you'll be jail for all of about a week based on our useless system of time served, statutory release and all of the other nonsense.

    This is an example of how screwed up things are . Berner should never have been allowed to file an appeal . She killed a child while drunk - that is a crime ...period.

    Now that her conviction has been rejected at the highest level, hopefully she'll get a quick decision that the sentence is the minimum she should have been given.

    Can the Court of Appeal issue a stiffer sentence? Because killing a child should be mandatory 5-10.

    BCCLU want to make it easier to drink & drive. Their point of view is you shouldn't have to blow into a screening device and it's your right not too. The people who refuse to blow are more than likely impaired, but by refusing, there should be no consequences. According to David Eby and friends.

    this evil stupid b*&tch wasting the court's time and causing more grief to little Alexa's family, serve your time you worthless piece of crap and who cares if you think police 'mishandled' your file - you think a clerical error will get you off from what YOU did - drunk drove, and killed a little girl? apple doesnt fall far from the tree either you loser, your son is also a piece of s*(Kt in trouble with the law, what a example he had to grow up with Carol. Hope people come out to boo you and throw dog crap at you at the court tomorrow.

    Odd that Ms. Berner isn't happy to go to jail. It would give her a good chance for some quality time with her son who is in for killing someone as well !

    Sounds like her family is a menace to society. Jail time won't change that but it will protect society from them for a couple years. Too bad she didn't get 10 years.
