The Criminal Justice Branch has filed an appeal with B.C.’s highest court in a Bountiful-related case.
A special prosecutor has asked the B.C. Court of Appeal to set aside the acquittal of James Oler, two weeks after being found not guilty of taking a girl across the border for a sexual purpose back in 2004.
Two weeks ago, a B.C. Supreme Court judge found former husband and wife Brandon and Gail Blackmore guilty of the same charge.
The special prosecutor is seeking a ruling the acquittal be set aside for a conviction or the ordering of a new trial.
