A judge has refused to certify a B.C. class action lawsuit against the makers of Cold-FX.
Don Harrison launched the lawsuit alleging advertisement that says Cold-FX provides immediate short term relief of colds and flu is “unfounded and unapproved.”
But the judge ruled Harrison failed to prove there is an identifiable class and because he was recruited by his lawyer, he’s not a genuine plaintiff.
John Green, who represented Harrison, says they will appeal.
“His main complaint was that it didn’t work, he took it over three days, and his cold and flu symptoms didn’t get better.”
The company Valeant says that Cold-FX is not marketed as an after the fact cold remedy, but is a preventative immune boosting product.
