Last September, a vehicle driven by an off-duty police officer with the Penticton RCMP struck a five-year-old boy.
James McIntosh was hit while crossing an intersection at Highway 97 while riding his bike with his father and older brother.
He died later of his injuries.
The Chief Civilian Director of the IIO has completed his review of the case and has forwarded a report to Crown for consideration of charges.
It’s now up to the Criminal Justice Branch to determine if charges will be laid.
