An Abbotsford marijuana dispensary is launching a constitutional challenge to keep its doors open.
Lawyer Dean Davison argues the City of Abbotsford has no right to enforce federal laws against Don Briere’s Mary Jane’s Glass and Gifts.
“Medical marijuana dispensaries are dealing with federal laws, the courts have pretty consistently said quite recently that people have the right to access medical marijuana.”
Dean says the dispensary has filed papers under several sections of the constitution.
“People have the right to access marijuana, it’s part of your section seven rights. When the city of Abbotsford attempts to stop people from having that access, we say they are infringing people’s rights.”
“What they are doing is trying to say they don’t have a license and therefor closing them down. They are kind of going around the system but effectively what they are trying to do is enforce federal laws which they don’t really have a right to do.”
The injunction against both of Briere’s shops in Abbotsford was handed down in March.
One shop has closed down.
