A woman has filed a lawsuit in the BC Supreme Court after buying property without being told it came with building restrictions.
Jenny Wu claims the owner of the property, as well as the realtor, and West Coast Realty knew about the Right-of-Way agreement with the District of Burnaby and neglected to tell her. She says the property was falsely described as being almost 4,000 square feet, even though she wasn’t allowed to build anything larger than approximately 1,800 Square feet.
Wu allegedly told the parties she wanted to re-build to have a home almost double the size, and still wasn’t told she wouldn’t be allowed to. She bought the property for almost $1.5 million dollars.
None of the allegations have been proven in court.
On their website, the City of Burnaby says Right-of-way agreements appear on the Title of the property. Owners can apply to have the restrictions formally released.
