A private hydro-developer is still smarting after losing out on a project near Squamish.
Greengen Holdings is suing the Crown and Squamish Nation for delaying the consultation process and failing to engage meaningfully in the Fries Creek project they had proposed between 2003 and 2007.
Greengen says the Squamish Nation expressed a lack of support citing cultural reasons – a move which they say ultimately vetoed the project.
The Squamish Nation wanted the waters of Fries Creek to remain undeveloped.
Greengen is now alleging that Squamish Nation failed to act in good faith by delaying the consultation process and failing to engage meaningfully.
The company is seeking damages and asking for the bid decision to be considered invalid.
None of these claims have been tested in court.
