A Surrey ear, nose and throat doctor, who was suspended last year for making sexual comments while taking a patient out to dinner, is now being sued by the same woman involved.
We now know she is young enough to be the doctor’s granddaughter.
The woman says in a notice of civil claim filed in BC Supreme Court that Dr. Danilo Vargas used his position of authority to prey on her, used false pretences for the pair to be alone, and encouraged her to engage in inappropriate sexual relationship, although she declined, two years ago.
She was 20 years old, he was 69.
She says she thought she was attending a dinner to discuss a charity event with a group- but it was just the doctor.
She alleges he encouraged her to drink alcohol- took pictures, made lewd comments, and she was terrified.
She is suing under the negligence act for damages.
Dr. Vargas is practicing again after a three month suspension issued by the College of Physicians and Surgeons.
The College says it continues to ensure he complies with conditions- including education on ethics and boundaries.
None of the allegations have been proven in court.
Dr. Vargas has not responded to requests for an interview.
